- Consumer means an individual acting for purposes which are wholly or mainly outside their trade, business, craft, or profession.

- Order means your order for Services submitted through the Website.

- Services means the services advertised or supplied through the Website, including digital platform access, tools, consultancy services, and any related Goods where applicable.
- User Content means content uploaded or submitted by users, including listings, property details, messages, documents, and other materials.
- Website or Site means https://www.hatch-retail.space.
4. Eligibility and Accounts
To use certain features of the Site, you may be required to create an account. You can only purchase Services or Goods from the Website if you are eligible to enter into a contract and are at least 18 years old.
You agree to:
- Provide accurate and up-to-date information.
- Maintain the confidentiality of your login credentials.
- Accept responsibility for all activity under your account.
- Notify us immediately if you become aware of unauthorised use of your account.
We may suspend or terminate accounts at our discretion if these Terms are breached or the platform is misused.
5. Our Role
Hatch is a platform and consultancy provider only. Unless explicitly stated in a specific engagement, we are not:
- A landlord.
- A letting agent.
- A party to any property agreement between users or third parties.
Any agreements entered into between users, landlords, tenants, agents, or third parties are solely their responsibility.
6. Services
The description of the Services and any Goods is as set out on the Website, in catalogues, brochures, proposals, or other advertisements. Any description is for illustrative purposes only and there may be small discrepancies where Goods are supplied.
All Services shown on the Website are subject to availability. We may make changes to the Services where necessary to comply with applicable law, safety requirements, technical requirements, or operational improvements. Where required, we will notify you of these changes.
Where Services or Goods are made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.
7. Customer Responsibilities
You must cooperate with us in all matters relating to the Services. This includes providing information reasonably required to perform the Services, obtaining any necessary licences or consents, and ensuring that any information you provide is complete and accurate.
If you fail to comply with these responsibilities, this may be treated as a customer default. We may suspend performance of the Services until the issue is remedied, or terminate the Contract if the issue is not remedied following our request.
8. Orders, Basis of Sale, and Contract Formation
The description of Services and any Goods on the Website does not constitute a contractual offer to sell those Services or Goods. When you submit an Order, we may reject it for any reason, although we will try to tell you the reason without delay.
The order process on the Website allows you to check and amend errors before submitting your Order. It is your responsibility to ensure the Order is complete and accurate.
A Contract will be formed only when you receive an email from us confirming the Order (“Order Confirmation”). You must inform us immediately if there are any errors in the Order Confirmation.
Any quotation or estimate of fees is valid for a maximum period of 7 days from its date unless we withdraw it earlier or agree otherwise in writing.
No variation of the Contract can be made after it has been entered into unless agreed by both you and us in writing.
9. Services and Payments
We provide paid Services through the Site, which may include access to tools, consultancy services, digital products, platform features, reports, and related services.
By purchasing a Service, you agree:
- To pay all applicable fees displayed at the time of purchase or otherwise agreed in writing.
- That payments may be processed securely via third-party payment providers.
- That Services may be delivered digitally, through platform access, or via consultancy engagement.
All prices are shown in GBP unless otherwise stated. Fees and charges include VAT at the rate applicable at the time of the Order unless stated otherwise.
You must pay by submitting your payment details with your Order, and we may take payment immediately or before delivery of the Services.
10. Digital Services, Returns, and Refunds
Because many of our Services are digital and/or consultancy-based, we do not generally offer returns. Refunds are not provided once Services have been delivered, consultancy work has commenced, or digital access has been granted, except where required by law.
This does not affect any statutory rights you may have as a Consumer, including any cancellation rights described in these Terms where they apply.
If you believe there is an issue with a Service, please contact us at webmaster@hatch-retail.space.
11. Delivery and Performance
We will deliver or perform the Services within the agreed period or, if no period has been agreed, within a reasonable time.
Where Goods are supplied, we will deliver them to the agreed delivery location within the agreed period or, failing agreement, without undue delay and in any event not more than 30 days after the Contract is entered into.
If we do not deliver Services on time, you may require us to reduce the fees by an appropriate amount, which may be up to the full amount where appropriate.
If Goods are supplied and we fail to deliver them on time, you may have the right to treat the Contract as ended in certain circumstances, including where delivery on time was essential or we fail to deliver within a further appropriate period specified by you.
Where Goods are supplied, risk in the Goods passes to you on delivery. You do not own the Goods until we have received payment in full.
12. Withdrawal and Consumer Cancellation Rights
You can withdraw an Order before the Contract is made by telling us that you wish to change your mind.
If you are a Consumer and the Contract is a distance contract, you may have the right to cancel within 14 days without giving any reason, subject to the exceptions and rules set out below.
The cancellation period will expire:
- For Services only, 14 days from the day the Contract was entered into.
- For Goods, 14 days from the day you, or a third party indicated by you, acquire physical possession of the Goods.
- For Goods supplied over time, 14 days after the first delivery.
To exercise the right to cancel, you must inform us of your decision by a clear statement sent by post or email. You may use the model cancellation form at the end of these Terms, but this is not obligatory.
We must not begin supplying a Service before the end of the cancellation period unless you have expressly requested that we do so. If a Service is supplied during the cancellation period at your express request, you must pay an amount proportionate to the Service supplied up to the time you tell us you wish to cancel.
Where digital content or digital access is supplied immediately with your consent and acknowledgement that cancellation rights may be lost, your right to cancel may end once access or delivery begins, to the extent permitted by law.
13. Effects of Cancellation
If you validly cancel a Contract, we will reimburse payments received from you, including standard delivery costs where applicable, except for supplementary costs arising if you chose a delivery method other than the least expensive standard delivery offered by us.
We may deduct from reimbursement any loss in value of Goods caused by unnecessary handling by you.
If Goods have been supplied, you must return them to us at W8a Knoll Business Centre, 325-327 Old Shoreham Road, Hove, BN3 7GS, without undue delay and in any event not later than 14 days from the day you communicate cancellation. Unless otherwise required by law, you will bear the cost of returning Goods.
We will make reimbursement without undue delay and not later than 14 days after receiving returned Goods, evidence that Goods have been sent back, or your cancellation notice where no Goods were supplied.
14. User Content
Users may upload or submit User Content including listings, property details, messages, documents, and other materials.
By submitting User Content, you:
- Confirm that you have the rights to share it.
- Grant Hatch a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute it for platform and service purposes.
- Agree not to submit unlawful, misleading, defamatory, infringing, confidential, or harmful content.
We may remove any User Content at our discretion.
15. Acceptable Use
You agree not to:
- Use the Site for unlawful purposes.
- Attempt unauthorised access to systems, data, or accounts.
- Scrape, harvest, or extract data without permission.
- Upload malicious software, harmful code, or harmful content.
- Misrepresent your identity or affiliation.
- Interfere with the operation, security, or availability of the Site.
16. Intellectual Property
All Site content, software, branding, designs, text, graphics, databases, tools, and materials, excluding User Content, are owned by or licensed to Hatch Partnerships Ltd.
You may not copy, reproduce, distribute, modify, or create derivative works from our content without prior written permission, except as permitted by law or expressly allowed by these Terms.
17. Conformity and Service Standard
We have a legal duty to supply Goods, where applicable, in conformity with the Contract. Upon delivery, Goods will be of satisfactory quality, reasonably fit for any particular purpose made known to us before the Contract was made where reliance on our skill and judgement is reasonable, and conform to their description.
We will supply Services with reasonable skill and care.
Anything we say or write about the Services may form part of the Contract where you take it into account when deciding to enter into the Contract, subject to any qualification or agreed change.
18. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, or consequential loss.
- We do not guarantee uninterrupted, secure, or error-free access to the Site.
- We are not responsible for decisions made based on information on the Site.
- We are not liable for loss that was not reasonably foreseeable when the Contract was made.
- Where you are acting as a Consumer, we are not liable for business losses such as loss of profit, revenue, business opportunity, or goodwill.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.
19. Third-Party Services
The Site may integrate with or link to third-party tools, payment processors, external websites, or other third-party services. We are not responsible for third-party content, availability, terms, policies, or services.
20. Privacy and Personal Information
Your privacy is important to us. We respect your privacy and comply with applicable data protection laws, including the UK General Data Protection Regulation.
These Terms should be read alongside our Privacy Policy and Cookie Policy where available.
For the purposes of these Terms:
- Data Protection Laws means any applicable law relating to the processing of personal data, including the UK GDPR.

21. Termination and Suspension
The Contract continues for as long as it takes us to perform the Services, unless terminated earlier in accordance with these Terms.
Either you or we may terminate the Contract or suspend Services by written notice if the other party commits a serious breach and does not remedy it within 30 days of written notice, or is subject to steps towards bankruptcy, liquidation, or insolvency.
We may also suspend or terminate access to the Site at any time if you breach these Terms, misuse the platform, or create legal, security, or operational risk.
Termination does not affect any rights or liabilities that have already arisen.
22. Circumstances Beyond Our Control
If either party fails to perform obligations because of something beyond its reasonable control, that party will notify the other as soon as reasonably practicable. Obligations will be suspended so far as reasonable, provided the affected party acts reasonably. This does not affect your statutory rights relating to delivery or cancellation.
23. Successors and Subcontractors
Either party may transfer the benefit of the Contract to someone else but will remain liable for its obligations unless otherwise agreed or permitted by law. We may use subcontractors to help perform our duties and will be responsible for the acts of subcontractors we choose.

These Terms and any Contract are governed by the laws of England and Wales.
Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that where you are a Consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts of Scotland or Northern Ireland respectively.
